Rule Changes: Supreme Court approves changes in FRCP regarding Electronic Discovery
Today the United States Supreme Court approved changes to the Federal Rules of Civil Procedure to better address the discovery of electronically stored information.  If approved by Congress the rules will take effect on December 1st, 2006.  These changes effect Rules 16, 26, 33, 34, 37, and 45, as well as Form 35. The most significant changes will include the requirement to identify and disclose information regarding electronically stored information, the ability to produce documents in a native format or other reasonably useable formats and the ability to claim privilege on documents after document productions.
